Case filed against firm infringing ATLAS’ intellectual property rights

The Crime Investigation Department has filed action under the terms of the Intellectual Property Act on 10 December 2014 against Daham Asitha Wijerathna of D.S.L. Enterprises Ltd., at No. 147/7, Railaway Station Road, Moratuwa before Aravinda Perera, the Chief Magistrate/District Judge of Moratuwa.
It was reported that 8,928 pencils issued to the market under the brand name of ‘Yellow Pencil’, were taken into custody on a search warrant obtained from the court on 5 December 2014.
Yellow Pencil has been registered under Ceylon Pencil Co. Ltd. (ATLAS) as an Industrial Design and only the Ceylon Pencil Company (ATLAS) holds all the intellectual property rights, including sale and distribution of Yellow Pencil.
Accordingly, the court ordered to discharge the suspect, Wijerathna, on Personal Bail of Rs. 500,000. Wijerathna allegedly imported and distributed the said wrongfully imitated Yellow Pencils arrested on a complaint made by Ceylon Pencil Co. Ltd. (ATLAS).
This case was fixed for trial on 19 January 2015. The prosecution in this case is conducted by the Intellectual Property Investigation Unit of the Crime Investigation Department.
