Red Bull locks horns over trademark

Colombo High Court issued enjoining orders preventing the Defendant Company United Ceylon Venture Traders from causing to be released into free circulation the allegedly infringing products ‘Red Bull’ energy drink sequent to the litigation initiated by Red Bull AG of Switzerland. The matter came up before High Court Judge M.C.B.S. Moraes where A.P. Subramaniam who is carrying on business in the name of United Ceylon Venture Traders and the Director General of Customs are cited as Defendants. Plaintiff Red Bull AG claims that it is a wholly owned subsidy of Red Bull and has exclusive right to import, export, distribute and market the Red Bull Drink manufactured by Red Bull GmbH in several countries of the world including Sri Lanka. It initiated legal action related to the importation of and dealing in by the 1st Defendant of goods in alleged contravention of its rights. The Director General of Customs has, acting in terms of Customs Ordinance, suspended the release into free circulation of goods imported by the 1st Defendant, it states in its plaints. Manoj Bandara with Lakshana Perera instructed by Sudath Perera Associates appeared for the Plaintiff.
