SC stays CA Interim Order against Ansell Lanka

Supreme Court on Friday granted Interim Order until 6 February staying the operation of the ex-parte Interim Order issued by the Gampaha Appeal High Court against Ansell Lanka Ltd enabling the reinstating of terminated employees. The Bench comprised Chief Justice Mohan Peiris, Justices Chandra Ekanayake and Rohini Marasinghe. The Court granted this Interim Order sequent to the appeal application filed by the Ansell Lanka Ltd citing H.L.C.U. Gooneratne as Plaintiff-Petitioner-Respondent. The petition is fixed for support on 5 February. The Appellant Ansell Lanka Ltd of Biyagama is the local subsidiary of world renowned glove manufacturer Ansell Ltd of Australia. The Appellant was established as a licensed enterprise within the Biyagama Exporting Processing Zone and employs 2100 workmen consisting of 1520 permanent employees and also provides indirect employment to a further 15,000 persons. Petitioner Company states that Free Trade Zones and General Services Employees Union (FTZ Union) has been agitating for a check off system where the subscription or membership fees of the said union are deducted from the employee salaries and remitted directly to the said Union. It states that it has not acceded to this and the said Union has been causing disruption through their members who are employed with it in order to pressurise its management to accede to the check-off system. Nigel Hatch PC with Kusan de Alwis PC, Manoj Bandara and Lakshana Perera instructed by Sudath Perera Associates appeared for the Petitioner Company.
