Enjoining order restraining sale of Kalpitiya ‘Divvyaa Lagoon Resorts’ by Seylan

The Commercial High Court of Western Province issued an Enjoining Order against Seylan Bank Plc, restraining it from taking any steps whatsoever to sell by public auction the premises of ‘Divvyaa Lagoon Resorts,’ Kalpitiya, in the Puttalam District. Colombo High Court Judge Aruna Ranasinghe issued the Enjoining Order operative till 2 October sequent to a plaint filed by the Plaintiff Divvyaa Lagoon Resort against the Defendant Seylan Bank Plc. Application for Enjoining Order was supported by Farman Cassim with Charaka Jayaratne instructed by Lanka Darmasiri appearing for the Plaintiff. Plaintiff states it purchased the said premises consisting of three acres and three roods in Kalpitiya in the Puttalam District under its former name ‘Grant Communications Pvt. Ltd.’ It further states it runs the business of a tourist boutique resort, namely ‘Divvyaa Lagoon Resorts’.
