Commercial High Court vacates enjoining order against Planto Ceylon

The Commercial High Court of Colombo, yesterday (29) made an order to vacate the enjoining order issued against Planto Ceylon Ltd. and its Directors (defendants) that prevented them from manufacturing, selling, marketing and distributing their beverage, “KicoVera”.

The court had earlier issued an enjoining order under a lawsuit filed by Silvermill Natural Beverages Ltd., under the Intellectual Property Act No. 36 of 2003 on the basis of infringement of the plaintiff’s intellectual property rights. Dinal Phillips PC made submissions on behalf of the defendants that the plaintiff had suppressed facts to court and after considering same, the Commercial High Court decided to vacate the enjoining order.

The defendants were represented by Dinal Philips PC with Shalani Gunawardena AAL, Thevuni Amaradasa AAL and Tirashi Fernando, on the instructions of Invictus Law.
