Informatics gets interim injunction against Scicom Lanka and others

The Commercial High Court on Tuesday awarded interim injunctions against several Defendants preventing them from violating the Intellectual Property Rights of Informatics International Ltd., until the final determination of the case. 

Informatics is a pioneer in IT and a company providing highly sophisticated e-Government software solutions to institutions both in Sri Lanka and overseas. Informatics also provides core software for insurance, telecommunication and other enterprise business related software solutions.

This case has been filed by Informatics against six of its former employees, a Sri Lankan company who is their current employer and its Malaysian parent company. These former employees had been involved in the development, maintenance and management of highly sophisticated software products of Informatics and have had access to confidential information pertaining to such software products. Informatics claimed that these former employees along with their current employer have been making unfair and unethical use of this confidential information. 

Three interim injunctions have been granted until the final determination of the case where one prevented all eight Defendants from directly and/or indirectly contacting the clients and customers of Informatics. 

Another prevented the First, Fourth, Fifth, Sixth, Seventh and Eighth Defendants, who were the former employees of Informatics, from providing or being employed or being otherwise consulted in providing similar software solutions. 

The other third interim injunction was issued against the Second and Third Defendants or any of their employees, servants, agents or assigns from using, selling, marketing or dealing in any manner of the software products of Informatics.

The Plaintiff in this case was Informatics International Ltd. and the eight Defendants were Vignarajah Manoharan (First Defendant), Scicom Lanka Ltd. (Second Defendant), Scicom (Msc) Berhad, Malaysian parent company (Third Defendant), Malgani Rushika Karunaratne (Fourth Defendant), K. Kugamohan (Fifth Defendant), Asanka Rathnadeepa Dhananjaya Dissanayake (Sixth Defendant), Palihawadana Arachchige Rangi Suyama Perera (Seventh Defendant) and Chamika Nuwan Obeysekera (Eighth Defendant).

Chandaka Jayasundere President’s Counsel with Attorney-at-Law Chinthaka Fernando instructed by Attorney-at-Law Sanath Wijewardane appeared for the Plaintiff Informatics International. 

K. Kanag-Isvaran President’s Counsel with Attorney-at-Law Nigel Bartholomeusz and Attorney-at-Law Lakshmanan Jeyakumar instructed by Sinnadurai Sundaralingam and Balendra Associates appeared for the Defendants.
