Lawyers’ Collective urges voters to prioritise democracy, rule of law and judicial independence

In the lead up to the Presidential election on 21 September, the Lawyers’ Collective has issued a crucial statement emphasising the importance of safeguarding democratic governance, the rule of law, and the independence of the judiciary. This call to action comes as the country grapples with the pressing need for institutional reform and accountability.



In a statement issued yesterday, the Lawyers’ Collective highlighted that a thriving democracy requires a balanced respect for the distinct powers and responsibilities of Parliament, the Executive, and the Courts. They stressed that maintaining the rule of law is essential not only for the well-being of the nation but also for fostering a sustainable economy, a just social order, and accountable governance.

The Collective underscored several key elements of the rule of law, including the right to participate in governance, periodic free and fair elections, judicial independence, and the prevention of corruption. They also emphasised the need for transparency in governance, equitable power sharing, and the protection of human rights.

Sri Lanka, according to the statement, has experienced a gradual erosion of democratic values and legal norms, which has negatively impacted both the economy and the daily lives of its citizens. The decline in the rule of law has led to economic mismanagement, widespread corruption, impunity, and significant human rights abuses. The economic and political crisis of 2022, the Collective argued, is a direct result of this breakdown in governance.

To address these issues, the Lawyers’ Collective has called for the election of a President who is committed to upholding the independence and integrity of key institutions, including the judiciary, the Constitutional Council, the police, and independent commissions. They stressed that safeguarding these institutions from political interference is crucial for the country’s sustainable development.

A major concern highlighted by the Collective is the need to address the unchecked powers of the Executive Presidency. They noted that the 19th Amendment to the Constitution aimed to curb Presidential abuses by enhancing the role of the Supreme Court. The Collective reiterated the importance of preserving judicial independence, which is fundamental for protecting democratic values and ensuring that citizens can seek redress for violations of their rights.

The statement pointed out that the newly elected President will have a significant role in shaping the future of the judiciary and other key institutions, including filling several vacancies in the apex courts. The upcoming vacancy in the office of Chief Justice in December 2024 will also be a critical moment for the future of judicial independence, it said. 

As voters head to the polls, the Lawyers’ Collective urged them to consider the essential need to strengthen democratic institutions, uphold the rule of law, and protect the independence of the judiciary.
