SC rules Petroleum Products Bill inconsistent with Constitution

  • Energy Minister Kanchana Wijesekera says Bill will be amended

The Supreme Court has determined that the Petroleum Products (Special Provisions) (Amendment) Bill is inconsistent, as a whole, with Article 12 (1) of the Constitution.

The determination of the Supreme Court was announced in Parliament by Speaker Mahinda Yapa Abeywardena yesterday.

The Speaker said the Supreme Court has determined that the Bill will be required to be passed with a special majority unless the inconsistencies are amended.

The Supreme Court has also determined that inconsistencies including the composition of the proposed committee under the Bill will cease if amendments are made.

On 31 August the Petroleum Products (Special Provisions) (Amendment) Bill was presented in Parliament by Power and Energy Minister Kanchana Wijesekera. 

Separately, the Minister said the proposed Petroleum Products (Special Provisions) (Amendment) Bill will be amended.

“The Bill will be amended to cease the inconsistencies in line with the Supreme Court determination,” Wijesekera tweeted.
