Under Armour enforces IP Rights in Sri Lanka

Two actions were filed in the Nugegoda Magistrates Court against Cool Planet Ltd., based on complaints lodged at the Colombo Crimes Division on behalf of the brand owner, Under Armour, through its legal representatives, Sudath Perera Associates. 

The actions were filed under the Intellectual Property Act No. 36 of 2003 for the sale of counterfeit products at the Cool Planet outlets in Maharagama and Nugegoda. 

The counterfeit products contained the registered trademarks of the well-known international sporting brand, Under Armour, which has recently opened a store at Independence Arcade in Colombo. The Accused pleaded guilty to all charges in both cases and the Nugegoda Magistrate Mohammed Mihail imposed a fine of Rs. 200,000 on the accused for both cases. 

An order for the destruction of the goods was also given and the original file along with the complaint are to be released to the virtual complainant.  Sub-inspector Nimal Shantha of the Prosecution Branch of CCD along with Senior Counsel Deshan Hewavitharana and Junior Counsel Hasitha Gamage instructed by Sudath Perera Associates represented the interests of the brand owner, Under Armour, during the hearings.
