E-Channelling Plc yesterday secured two separate enjoining orders against Dialog Axiata Plc and Nawaloka Hospitals Plc in the Commercial High Court of the Western Province.
The enjoining order against Dialog was preventing the latter from utilising confidential information supplied by E-Chanelling to develop and/ or commercially launch a rival IT system for customers and/ or the public to channel doctors and/ or medical professionals through their mobile telephones pending the final hearing and determination of the application for the Interim Injunction.
The enjoining order was granted by Commercial High Court Judge E.A.G.R. Amarasekera. Counsel representing E-Channelling PLC was Nigel Hatch Esq. PC with Siroshni Illangage and Nithya Kumaraswamy instructed by Wijesinghe Associates
In the plaint against Nawaloka Hospitals PLC was retaining the latter from engaging and/or entering into any Agreement and/or conducting any business and/or investing and/or having any interest directly or indirectly with any third party in any project or program to obtain services similar or identical to that which E-Channelling provides to the Hospital under the Agreement dated 4 October 2013 pending the final hearing and determination of the application for the Interim Injunction.
This enjoining order too was granted by Commercial High Court Judge E. A. G. R. Amarasekera. Counsel represents E-Channelling PLC was Nigel Hatch Esq. PC with SiroshniIllangage and Nithya Kumaraswamy and instructed by Indunil Bandara.
The trial on the case has been fixed for 27 August.
