Toyota gets Supreme Court nod to appeal

The Supreme Court has granted special leave to appeal against the order of the Court of Appeal which refused to issue notice on the Customs in the Writ petition filed by Toyota Lanka (Pvt) Ltd., seeking to prevent Customs from recovering short payment from it in respect of importation of motor vehicles.

The Bench comprising Justices N.G. Amaratunga, Saleem Marsoof and Suresh Chandra granted special leave to appeal on the question of law. Short written submissions are to be made by the parties on or before 17 December. The Court reserved its judgment.

Petitioner Company Toyota Lanka (Pvt) Ltd. filed two separate petitions in respect of two separate Writ application of the Court of Appeal.

It cited the Director General of Customs, Assistant Director of Customs K. Premnath and Addl. Director General of Customs W. A. Chandradasa as Respondents.

Faisz Musthapha PC instructed by Gowry Shangary Thavarasha appeared for the Petitioner Toyota Lanka, challenging Customs from covering the purported short payment amounting to the tune of Rs 274,088,366.
