The District Court of Colombo yesterday issued several enjoining orders restraining specified individuals and their agents from selling, mortgaging, renting, subletting and/or in any other manner alienating or disposing a 34.31 perch land and premises situated at No. 49/1, Jawatta Road, Colombo 5, the premises where the salon ‘Cutting Station’ was previously located.
The land, containing a colonial style residential building, is currently owned by an Australian citizen who inherited the premises. It had been taken over by force by a group of unknown individuals who broke into and acquired the premises after threatening the security service providers retained by the owner to guard the premises.
A fraudulent power of attorney was thereafter executed by an individual claiming to be the lawful power of attorney holder of the owner.
Under this alleged fraudulent power of attorney, the said individual leased the premises and has attempted to sell the premises to unsuspecting buyers. District Court of Colombo Judge Sandun Vithanage issued several enjoining orders restraining the said individual from representing to be the owner’s power of attorney holder and from dealing with the said premises and also permitted the owner to register a lis pendens pertaining to the property.
Faizer Musthapha, President’s Counsel, with Pulasthi Rupasinghe instructed by Messrs. F. J. & G. de Saram, appeared for the owner of the premises.
