AG resists JVP petition to arrest KP

The Attorney General yesterday resisted Petitioner Janatha Vimukthi Peramuna’s contention for a Writ of Mandamus from the Court to arrest and institute legal proceedings against Kumaran Pathmanathan (KP).

Additional Solicitor General Kapila Waidyaratne appearing for the Attorney General contended that the Writ of Mandamus (an order from the court to an inferior government official ordering them to properly fulfil their official duties or correct an abuse of discretion) will not apply as investigation is going on and it is a complicated and very sensitive matter.

The Bench comprising Justices Vijith Malalgoda (President/CA) and S. Thurairajah fixed the matter for support on 17 March.

The Attorney General on 3 February furnished to the Court the progress report on the investigation on the alleged involvement of Kumaran Pathmanathan (KP) in LTTE activities.

The Attorney General had also informed Court that the investigation was still continuing and statements were being recorded from KP.

Janatha Vimukthi Peramuna (JVP) Parliamentarian Vijitha Herath had filed the Writ petition seeking an order from the Court to arrest and institute legal proceedings against Shanmugam Kumaran Tharmalingham alias Kumaran Pathmanathan.

Upul Kumarapperuma with Sunil Watagala, Kaushalya Perera, Thanuka Nandasiri, Jayantha Dehiattage and Heshani Jayasuriya appeared for the petitioner.
