Attorney General summoned by Appeal Court in case against KP

The Appeal Court yesterday issued notice on the Attorney General to appear before the Court on 5 February in connection with the writ application filed by the Janatha Vimukthi Peramuna (JVP) against former LTTE arms procurer Kumaran Pathmanathan alias KP. The notice was issued when the petition was taken up for hearing before Justice A.H.M.D. Nawaz and Justice Vijith Malalgoda. The petition, filed in the Court of Appeal last week by the JVP, sought Writs of Mandamus to arrest KP and produce him in court to investigate the offences committed by him and initiate judicial proceedings against him. The respondents in the petition include the Army Commander, Inspector General of Police and controller of the Immigration and Emigration Department. Petitioner’s Counsel Upul Kumarapperuma told court today that Kumaran Pathmanathan had not been prosecuted thus far nor had legal proceedings conducted against him. JVP Propaganda Secretary Vijitha Herath said the Appeal Court had decided to check the earlier investigations carried out by the Army and the Police on the charges levelled against KP. KP was an international arms smuggler who procured weapons worth billions of dollars for the terrorist organisation which waged a deadly war in Sri Lanka for 30 years. He was involved in arms smuggling operations across Asia, Canada, US and Europe. Sri Lankan authorities arrested KP in Malaysia in August 2009 and brought him to Sri Lanka. He was under the protective custody of the Rajapaksa Government. The case will be taken up on 5 February.
