Kama fiasco: Court refuses bail for businessman

By Lakmal Sooriyagoda The Colombo Fort Magistrate yesterday turned down a bail application filed on behalf of the businessman who was arrested for allegedly assaulting a 21-year -old youth at the Kama- Colombo nightclub. Former Attorney General C.R. De Silva PC and Shanaka Ranasinghe PC had filed a motion before Magistrate Thilina Gamage asking the suspect businessman Ali Asger Shabbir Gulamhusein be released on bail. Defence counsel moved Court that the suspect be released on bail because the offence was a bailable offence and that the suspect would not exert threats to the witnesses involved in the incident. Meanwhile, President’s Counsel Nalin Ladduwahetty with counsel Shiraz Noordeen appearing for the agreed party requested Court that the bail application be considered next day in which the suspect had been ordered to be remanded on a previous date. Ladduwahetty complained to Court that various parties were exerting pressure on the victim and his family and also said that there had been attempts to pressurise the hospital in which the victim was being treated. Counsel further submitted that the victim is to undergo eye surgery. Meanwhile, the Kollupitiya police informed Court that they were yet conclude their investigations into the incident.  While rejecting the bail application filed by defence, the Magistrate observed that no adequate facts were present before Court to consider that the suspect to be release on bail. On 8 July, Magistrate Thilina Gamage remanded three suspects including two bouncers of the Kama-Colombo till 11 July for allegedly brutally assaulting the 21-year-old youth within and outside the nightclub on early Saturday morning (6 July). Two bouncers are to be produced before at an identification parade on Thursday (11 July).
